New charges have been filed against a Monroe City, Mo., man who already has been jailed on child pornography charges.
Monroe County Prosecuting Attorney Talley Kendrick has filed two charges against Daniel M. Hemphill, 51, in a separate case. On Friday, Hemphill was charged with sexual exploitation of a minor child, a Class A felony, and statutory sodomy, an unclassified felony.
According to the probable cause statement, members of the Monroe City Police Department and the Missouri State Technical Assistance Team executed a search warrant on Hemphill's residence in the 400 block of North Chestnut on Aug. 14. Hemphill was not at home when officers arrived, but his estranged wife, Lisa, arrived several minutes later. Lisa Hemphill told investigators that she had lived at the residence for several weeks but had two personal computers at her residence that Daniel Hemphill had access to when they lived together. She gave investigators consent to forensically examine the computers.
The forensic examination of those computers revealed multiple photographs depicting an 8-year-old girl sleeping on a sofa. There were at least 25 photos showing the child with her vagina exposed, her underwear pulled to the side or downj. There were two photos of a male hand touching the girl's privates. There was at least one photo showing a penis near the lips of the sleeping girl, a nonblood relative. The photos were dated June 17, 2012.
Officers found a sofa matching the one in the photos in Daniel Hemphill's home. A forensic examination was also done on a computer inside Hemphill's home. A document on the computer disclosed that Hemphill was willing to trade and send photos of child pornography. The document states that Hemphill had traded photos of the girl and her younger sister before. He admits in the document that he usually trades pictures that he takes.
Hemphill admits that he "loves girls of all ages but 3-14 are my faves ... not in to (sic) boys at this time."
If convicted of the charges, Hemphill could be sentenced to between 10 and 30 years in the Missouri Department of Corrections. His bond was set at $100,000. He's scheduled to have a counsel status hearing March 5.
Hemphill is currently being lodged in the Monroe County Jail because of his other case. An investigator with the Missouri State Technical Assistance Team found that Hemphill possessed 388 images of young children in various sexual situations. Among the items seized were multiple compact discs, a USB storage device, multiple computer hard drives and a Dell computer tower.
Hemphill faces eight felony counts in that case, six Class B felonies and two Class felonies. Seven of the counts dealt with possession of child pornography and one count with promotion of child pornography.
Hemphill was living in Quincy during the investigation. He was arrested without incident in Quincy at the corner of Eighth and Broadway on Dec. 3 on a Monroe County warrant and was taken to the Monroe County Jail in Paris. He is being held in lieu of a $350,000 cash-only bond. His next court hearing in that case is a disposition hearing March 7.
